Unsurprising.
On the surface the ruling isn’t awful because it’s the old TERF play of: “they’re entitled to protection from discrimination on the basis of their transgender characteristic but not under the basis of being a woman”, so effectively it means that under the eyes of the law a “trans woman” is the characteristics “man” + “transgender” which is essentially how the TERFs see it with their newspeak slurs (“TIM”,“TIL”).
But de-facto this has already long been the case anyway. The real reason trans women have any legal protections remaining at all is because it’s a violation of privacy to actually go and check if someone has had a GRC and this ruling doesn’t change that and even reasserts that in some situations trans women are entitled to protections based on perceived sex, as improvable and meaningless as that is.
I think the real play here is to clarify that the GRA and the EA2010 are in contradiction because the latter refers to “biological sex”, because that is a cassus beli for repealing the GRA outright, which is the ultimate goal.
We lost the war, and this is the enforcement settlement.
